misˈjoinder Law. [mis-1 4.] Improper joinder of parties in an action or of causes of action in a suit.
1852Act 15 & 16 Vict. c. 76 §35 In case it shall appear at the Trial of any Action that there has been a Misjoinder of Plaintiffs. 1857Kerr Blackstone's Comm. III. xx. 324 In actions of tort the plaintiff may always remedy a misjoinder of defendants, by entering a nolle prosequi, as to the defendant misjoined. 1883[see joinder b]. |
