‘A plea in bar to a real action, by saying that he (the defendant) held not the land in the plaintiff's count or declaration, or at least some part thereof’ (Wharton).
1574tr. Littleton's Tenures 128 b, If anye manne sue a Precipe quod reddat againste anye tenaunte of free hold, in whiche action..the tenaunte pledeth not nontenure. 1602W. Fulbecke 2nd Pt.
