Etymology: < medieval Latin dēclīnātōrius ( < participial stem dēclīnāt- of dēclīnāre : see -ory suffix2), in the legal expression exceptio dēclīnātōria, in French exception déclinatoire. French has also the noun use (1381 in Hatzfeld & Darmesteter).
A. adj.
That declines (sense 14a); expressing refusal. declinatory plea (Law): a plea intended to show that the party was exempt from the jurisdiction of the court, or from the penalty of the law; abolished in 1826.
