Etymology: < post-classical Latin in contumaciam (1728 or earlier) < classical Latin in in prep. + contumāciam , accusative of contumācia contumacy n.Compare the following earlier example of per contumaciam:1721 J. Strype Eccl. Memorials III. ii. 24 Smith, Hooper and Latymer, appeared not, who are said to be absent per Contumaciam.
In the unauthorized absence of the person or persons charged.The term means in contempt of court, and is typically applied to the sentencing of a defendant who refuses to appear for trial.
