Inviolability of the Home

one of the constitutional personal rights and freedoms of citizens. The constitutions of socialist countries guarantee citizens inviolability of the home (for example, the Constitution of the USSR, art. 128). This means that a citizen’s home may be entered without his consent only by representatives of the state authorities in instances provided for by law, for example, to conduct a search or view of an apartment if there are sufficient grounds to believe that the instruments of a crime or property acquired in a criminal manner will be found. Criminal responsibility has been established for illegal actions that infringe the inviolability of the homes of citizens in the USSR and other socialist countries.

The inviolability of the home is proclaimed in the constitutions of the bourgeois countries, but the legislation of those countries does not generally contain real guarantees of this right.
