Problems with Nextel service

Ask a Lawyer

Question

Country: United States of America
State: New JerseyMy finance and I signed up with Nextel cellular phone services. We have been with them for 3 months now and for three months we have had nothing but billing problems. Every month they make a $500-$800 mistake that we have to call them and argue that that is not what we signed up for. Every time we call we end up spending anywhere from 1-2 hours just trying to fix their mistakes. We want out of the service contract due to the stress that they are causing every month. Both of us are extremely busy and do not have time to stress about our bill every month and make phone calls. They have admitted every time that it is their fault and say that they have fixed the problem. We checked our bill last night and it was over $500 again! Is there some kind of law that I throw at them in order to legally get out of our contracts? Do I have any legal standing argument here?

Answer

Based on what you say here, you could probably file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney. You could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
