Question

Country: United States of America
State: OklahomaMy son and I are suppeaned (sp?) to testify against my husband on the 7th of next month. Neither of us is wanting to testify. I know that I will probably be found in contempt, and not worried about it too much, but my son is only 15. It is not my choice that he doesn't testify, it is his own. He truly does not want to testify against his father. What could happen if he doesn't testify, and do we have the right to not testify?

Answer

Normally a wife need not testify against a husband and the same for a child. You may refuse and then the court will decide what to do.
