statutory union recognition procedure

statutory union recognition procedure

a legal entitlement for TRADE UNIONS to be recognized by an employer for COLLECTIVE BARGAINING purposes where it is the clear wish of the workers involved. Where a union is unable to obtain the employer's agreement, it may submit a claim for recognition to the CENTRAL ARBITRATION COMMITTEE (CAC). The CAC can award recognition where more than half of the relevant workforce are members of the union making the claim. Alternatively, it can organize a ballot of the workers. Recognition will be granted if a majority of those voting and 40% of the eligible workers vote for recognition.
