Restraint, Measure of

 

in criminal procedural law, a temporary restriction on the personal freedom of a defendant. In the USSR this restriction has been established to prevent at-tempts to hide from inquiry, investigation, or trial, hinder the establishment of the truth, or continue to engage in criminal activity; it is also used to ensure the execution of sentences. The restriction is applied by the person conducting an inquiry, investigator, procurator, or court if the grounds prescribed by law are present. Restraining measures include a written pledge not to leave, personal surety or the surety of a public organization, bail, and imprisonment under guard (arrest). In exceptional cases these measures may be applied to a suspect.
