Claim as to Quality
in civil law, a complaint by a purchaser or customer against a seller, supplier, or contractor concerning the poor quality of an article; a demand for elimination of defects, reduction of price, and reimbursement for losses. A claim is made when the quality of an article objectively fails to meet contract conditions, state standards, technical specifications, or models. In Soviet civil law the period for initiating claims related to defects is six months in the case of a sold article and one year in the case of a sold structure. The claim periods for defective articles sold by a retail trade organization are determined by the Rules for the Exchange of Industrial Goods Purchased in the Retail Trade System.
