The owner sometimes obtains a deed to the small parcel of land under the water and has the right to use the common elements consisting of the docks and perhaps some storage space,bathroom facilities,parking,and other such things.The concept is still relatively new and is meeting legal challenges from people claiming that it is inconsistent with doctrines of public trust and riparian rights.According to opponents, navigable waters are not subject to private ownership and,as a result,no one can sell condo-type rights in a boat slip upon the waters.
