Contract, breaking and entering of a home

Ask a Lawyer

Question

Country: United States of America
State: FloridaI've signed a contract to buy a house from a bank. The house in question was locked, but the sliding glass door was open. I and my partner have been in the house to clean, and we showed it to prospective buyers. The bank has directed their agent to file a police report for breaking and entering. I have a contract for it, so even though I have not closed, don't I have a right to enter for inspections etc. And if not, how can I make it go away. One other thing, they are saying I was in the house on a day that I did not go in. Does that make a difference as well?

Answer

You can say you thought it was okay--the police are not likely to want to arrest for this.
