Origin: A borrowing from Latin. Etymon: Latin factum.
Etymology: < classical Latin factum fact n., in post-classical Latin also in sense 3 (1682 or earlier). With sense 3 compare factus n.With sense 1 compare German Factum , (now usually) Faktum (1559 in legal context in this sense, frequently specifically ‘criminal act, crime’; 1545 in sense ‘fact’; in early use with Latin inflectional endings). In sense 2 in later use after French factum statement of facts in a legal case (1532 in Middle French; < classical Latin factum fact n.). It is possible that the use of post-classical Latin factum in sense 3 arose from a reinterpretation of the accusative of post-classical Latin factus in this sense (see factus n.) as representing a neuter noun.
1. Law. An act performed by a person, a deed, a transaction; (also as a mass noun) doing, execution. Also: a stated or established fact.Now chiefly in fraud (also mistake) in the factum: (U.S. Law) fraud involving misrepresentation or misunderstanding of the nature of an act, transaction, etc., rather than of the apparent reasons for undertaking it.
