Etymology: < post-classical Latin pacta sunt servanda (1535 in Melanchthon or earlier; 1770 or earlier in French context; 1798 or earlier in German context: see note) < classical Latin pacta , plural of pactum pact n. + sunt servanda ‘(they) must be kept’ ( < sunt , 3rd plural present indicative of esse to be (see be v.) + servanda , neuter plural of gerundive of servāre to keep: see serve v.3), after pacta et promissa semperne servanda sint whether agreements and promises should always be kept (Cicero De Officiis 3. 92); compare ideo servandum erit pactum conventum thus it will be necessary to keep the agreement made (Justinian Digest 2. 14. 13. 1).Compare the following earlier occurrence of the phrase honesta pacta sunt servanda 'honourable agreements should be kept' in English context, translating Melanchthon:1547 J. Hooper Answer Detection Deuyls Sophistrye sig. H 4v Man shuld consent unto these principles and knolege of them, scilicet deo obediendum esse. Adulterium est uitandum.
