in Scots property law, the urban servitude non aedificandi (‘not to build’), altius non tollendi (‘not to build beyond a certain height’) and non officiendi luminibus (‘not to interfere with light’) combine to restrain proprietors, from their otherwise existing rights, from building, extending upwards or otherwise acting to impede the other proprietor's light. There is authority for another servitude of light that prohibits the making of windows that would interfere with the neighbour's privacy. See EASEMENT.
