in the law of contract in Scotland, the term used for cases of extortion where a party contracts as a result of some force. The fear aspect may reflect the need for the party to have made the choice of entering the contract instead of meeting the force as a result of a serious threat and preventing contracts being set aside because of vain or foolish fear.
