4. Scots Law and Civil Law. The exhaustion of legal proceedings against a debtor; esp. the exhaustion of proceedings against a person primarily liable for a debt or payment, before proceedings are brought against a surety. Also: the seizure of a debtor's property as part of this process (see discuss v. 5a).In quot. 1678 with reference to theft rather than debt.Originally a feature of Roman civil law, discussion is treated in the French civil law code, and hence the civil codes of Louisiana and Quebec.
